1. Acceptance of These Terms

These Terms of Service ("Terms") form a binding agreement between you and Wishmon Inc. M8M Labs, located at Room 505-A363, Gukje Plaza, 66 Gimpohangang 9-ro 75beon-gil, Gurae-dong, Gimpo-si, Gyeonggi-do 10071, Republic of Korea ("Phone2Cam," "we," "us," or "our"), governing your use of the Phone2Cam - Home Security Cam mobile application and related services (together, the "Service").

By creating an account, pairing a device, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization or another person, you represent that you have authority to bind them to these Terms.

2. Description of the Service

Phone2Cam turns spare iOS and Android phones into local-first home security cameras. You pair two phones on one account: one runs "Camera Mode" and the other acts as the "Viewer."

Key characteristics of the Service:

• This version is free to use and shows no ads. There are no in-app purchases, paid subscriptions, paid cloud backup, or advertising yet. Nothing in the app requests, displays, or measures ads, and no advertising identifier is collected. If we introduce advertising later, we will update the Privacy Policy and the store privacy disclosures before any ad is served — see the Privacy Policy's Advertising section.
• Video stays local. Recorded clips remain on the camera phone by default. There is no cloud upload of clips in this version. On-device clips are bounded by a storage cap you configure and a ring-buffer, which means older clips are overwritten over time.
• Live video is peer-to-peer. Live streaming uses WebRTC and is encrypted with DTLS-SRTP. Our backend never receives, decodes, or stores your video. It relays only signaling metadata and may relay the encrypted connection (TURN) without seeing the media.
• Limited backend data. Our backend stores only what is needed to run the account and pairing: your account email; the household name and camera names you choose; event metadata (event type such as person or sound, a confidence score, a timestamp, and which camera produced it); and device registration information (model, OS, app version).
• Audio is off by default. An optional "loud-sound detection" feature measures loudness on-device only and stores no audio. Separately, audio capture is off by default and can be enabled only on a camera device, and only after you accept an in-app consent notice. When enabled, the camera captures live audio to your Viewer and — if you also turn on "include audio in saved clips" — into on-device recordings. As with video, audio stays on your devices (on-device or peer-to-peer) and is never sent to, decoded by, or stored on our backend. You are responsible for any consent the law requires (see Section 4).

We may add, change, or remove features over time. We provide no commitment that any particular feature will remain available.

3. Eligibility and Account Responsibility

You must be old enough to form a binding contract in your jurisdiction to use the Service. The Service is not directed to children: in the Republic of Korea, not to anyone under 14, and elsewhere not to anyone under the age set by local children's online privacy law (for example, 13 under COPPA in the United States). We confirm at sign-up that you are 14 or older. The operator is responsible for setting the appropriate app store age rating.

To use the Service you create an account with an email address and a password. We store passwords only as salted scrypt hashes and never in plaintext. You are responsible for:

• Providing accurate account information and keeping it current.
• Keeping your password and devices secure and confidential.
• All activity that occurs under your account, including activity by anyone you allow to access your household, cameras, or Viewer.

Notify us promptly at [email] if you believe your account or any paired device has been compromised.

4. Acceptable Use — Lawful Camera Placement and Recording

You are solely responsible for how, where, and what you record with the Service. You must place and use cameras lawfully and respectfully. In particular, you agree that:

• You will comply with all applicable laws. Recording, surveillance, audio/loudness, consent, notice, data-protection, and privacy laws vary by country, state, and locality. You are responsible for knowing and following the laws that apply to you. Requirements differ and may include posting notice or obtaining consent before recording.
• You will not record people who do not reasonably expect to be recorded. Do not point cameras at, or record, individuals in circumstances where they would reasonably expect privacy.
• You will not record others' private spaces. Do not aim a camera into a neighbor's home, window, yard, or any space that is not yours to monitor.
• You will not record private areas where people expect privacy, such as bathrooms, changing rooms, bedrooms used by others, or similar spaces.
• You will be cautious with public, shared, or common spaces. Recording shared hallways, building entrances, workplaces, or public areas may require notice, consent, or building or employer permission, and may be restricted or prohibited where you are.
• You will obtain any consent the law requires from people who may be recorded, including for any loudness detection or audio capture you choose to enable. Audio recording is regulated more strictly than video in many places and may require the consent of every person recorded; some jurisdictions require all-party consent.
• You will not use the Service to harass, stalk, intimidate, spy on, or otherwise harm any person, or for any unlawful, infringing, or abusive purpose.

You also agree not to: reverse engineer, interfere with, or disrupt the Service; attempt to access accounts, households, or data that are not yours; circumvent the visible recording indicator or attempt covert recording; or use the Service in any way that violates these Terms or applicable law.

The Service is a tool, not a judge of legality. We do not review your camera placement or recordings, and we are not responsible for your compliance with recording or consent laws. You agree to indemnify and hold us harmless from claims arising out of your camera placement, recordings, or violation of this section, to the extent permitted by applicable law.

5. The Service Is Not a Guaranteed or Monitored Security Service

Please read this section carefully. The Service is a convenience tool, not a professional security, alarm, or monitoring service.

• Foreground-only recording. Camera Mode records only while the app is in the foreground with a visible recording indicator. The Service does not perform background or stealth recording. If the app is closed, backgrounded, or interrupted by the operating system, calls, low power, storage limits, or other conditions, recording may stop.
• No guarantee that every event is captured. Detection (such as person or sound events) and recording depend on your devices, camera placement, network conditions, lighting, available storage, battery, and platform behavior. We do not warrant that the Service will detect, capture, record, notify you of, or retain any particular event.
• No emergency or dispatch service. The Service does not contact, summon, or dispatch police, fire, medical, security, or any other emergency or response service, and it is not monitored by us or any third party. In an emergency, contact your local emergency services directly. Do not rely on the Service to protect life, health, or property.
• No professional monitoring. No person at Phone2Cam watches your cameras or reviews your events. Notifications and live viewing depend on your devices and network being online and reachable.

You acknowledge that you should not rely on the Service as your sole means of security, life safety, or property protection.

6. Service Availability — "As Is"

The Service is provided on an "as is" and "as available" basis. Live video depends on peer-to-peer connectivity, your local network, and the public internet, which we do not control. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or available at any particular time or place. We may modify, suspend, limit, or discontinue all or part of the Service at any time, including for maintenance, updates, or operational reasons.

7. Your Content and Data

You retain ownership of and responsibility for the content you create with the Service, including recorded clips (which stay on your camera phone) and the names you choose for your household and cameras.

We process the limited backend data described in Section 2 and in our Privacy Policy to operate the account and pairing. Because clips and live video stay on your devices or flow peer-to-peer, we do not host, store, or have access to your video.

You are responsible for backing up clips that matter to you before they are overwritten by the storage cap or ring-buffer, or before account deletion. By using the Service, you grant us only the limited rights necessary to operate the account and pairing features (for example, relaying signaling metadata and, where needed, relaying the encrypted media connection via TURN without accessing the media).

8. Termination and Account Deletion

You may stop using the Service at any time.

Delete your account in the app at Settings -> Manage account -> Delete account. Deletion removes the account, the household data you own, camera registrations, event metadata, server-stored clips (if any), live sessions, and subscription records, and invalidates existing sessions. Clips stored on your own device are removed by you on the device; deleting the app or clearing local storage removes on-device clips.

If you cannot access the app, you may request deletion by emailing [email].

We may suspend or terminate your access if you violate these Terms, if we are required to by law, or if continued provision of the Service becomes impractical. Sections that by their nature should survive termination (including Acceptable Use, Disclaimers, Limitation of Liability, and Governing Law) will survive.

9. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, whether express, implied, or statutory. We expressly disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade.

Without limiting the foregoing, we do not warrant that the Service will: meet your requirements; operate uninterrupted, securely, or error-free; detect, capture, record, or retain any particular event; deliver any notification; provide any security, life-safety, or property protection; or be compatible with your devices or networks. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or property, loss of use, business interruption, or for any failure to detect, capture, record, notify, prevent, or respond to any event, intrusion, loss, injury, or damage, arising out of or related to the Service, even if we have been advised of the possibility of such damages.
• Our total aggregate liability arising out of or related to the Service and these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim and (b) KRW 100,000, except where applicable law does not permit such a limitation.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and may provide additional notice in the app or by email. Your continued use of the Service after changes take effect means you accept the revised Terms. If you do not agree, stop using the Service and delete your account.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-laws rules. The Seoul Central District Court (서울중앙지방법원) has exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service. This does not deprive you of the protection of mandatory consumer-protection laws of your country of residence, or of any right those laws give you to bring claims in your local courts.
